These General Conditions of Sale (hereinafter GSC) are valid for all purchases by customers of products and/or goods on the online shop floressence.ch owned by the company Super Dinamica Sagl

The offers of products and services published online are valid as long as they are visible on the site and while stocks last. The images on the site are provided for indicative purposes only. Super Dinamica Sagl declines all responsibility for any errors or inaccuracies relating to images, descriptive texts or availability.

  1. PRICES
    The prices indicated on the site are exclusively expressed in Swiss Francs (CHF). They include VAT (7.7%) and do not include shipping costs and any packaging which will be invoiced separately.
    Super Dinamica Sagl reserves the right to change its prices at any time. The prices invoiced to the customer at the time of the order remain unchanged. Any promotional discounts offered on the site can be combined with other discounts, unless otherwise provided.
    Any price differences, promotions or discounts of products in stores are possible and do not give rise to any claim for price adjustment or voucher.
  2. CONTRACT STIPULATION
    The products and prices published in the online shop are valid as an offer.
    The request to conclude a purchase contract comes from the Customer following the completion of the order and the mouse click "Buy now". In this way the customer is considered bound to the sales contract. The same is considered concluded only after express acceptance by Super Dinamica Sagl, as better indicated in the following paragraph (4. ORDER).

By sending the order, the Customer receives an order confirmation automatically generated and sent to the indicated e-mail address. Receipt of the order confirmation does not imply any confirmation that the product is actually available or can be delivered. The order confirmation simply informs the customer that the order has been received and will be processed.

  1. ORDERING
    Sending the order by the customer implies full and global acceptance, without reservation, of these General Conditions of Sale to the exclusion of other terms or conditions.
    The order is made effective only upon express acceptance by Super Dinamica Sagl via an email confirming the purchase, with the shipping confirmation or at the latest with the actual shipping of the product.
    The purchase contract is considered concluded only for the products explicitly indicated in the order acceptance email and/or shipping confirmation. Failure to fully or partially accept the order will consistently result in the return of the total or partial amount paid.

The customer has the opportunity to identify and correct entry errors before sending the order.

  1. PAYMENT
    The invoiced price is the price indicated on the order confirmation that is sent to the customer at the time of the order. The accepted payment methods are: Bank transfer, Paypal, EuroCard/MasterCard credit cards, Visa, Postcard, PostFinance.

All payment transactions are carried out in the protected area (“https://“) according to the highest possible security standard. The data recorded by Super Dinamica Sagl constitutes proof of all the transactions carried out between Super Dinamica Sagl and its customers. The data recorded by the payment system constitutes proof of financial transactions. The order is charged to the account or card used for payment at the time of dispatch.

Until full payment of the amount indicated in the invoice, respectively in the purchase confirmation email, the product(s) remain the property of Super Dinamica Sagl.

  1. SHIPPING
    Super Dinamica Sagl normally limits shipments to Swiss territory to the address indicated by the customer at the time of purchase, unless otherwise agreed. Any shipments outside of Switzerland, at the customer's request, must be agreed upon separately.

With the delivery of the goods to the carrier Super Dinamica Sagl is considered to have fulfilled its obligations and therefore is not responsible for any partial or total damage, loss or theft of the goods. These risks are assumed by the customer.

The shipping cost for Swiss territory is always free with a minimum order of 150 CHF, otherwise a shipping fee of 15 CHF will be charged.

For all shipments outside Swiss territory the conditions will be determined in relation to the quantity of the goods and the destination.

 

 

  1. REPLACEMENT, RETURN, WARRANTY PERFORMANCE AND COMPLAINTS
    It is the customer's responsibility to check the condition of the goods upon delivery within a reasonable time.

Any complaints related to defective goods and/or incomplete services, as well as returns must be immediately submitted by the customer directly to Floressence via email info@floressence.ch
Otherwise, after 7 days from receipt of the shipment or collection from the shops, the goods are considered accepted by the customer, without any reservations.

  1. CONDITIONS FOR RETURN
    Subject to specific conditions, the customer can exercise the right of return.
    It is up to the customer to check the goods upon receipt and communicate any defects or differences compared to his order.

It is possible to return or replace the purchased goods by presenting the purchase receipt. Only goods that are unused, clean and undamaged, intact and still have all their original characteristics (for example, label and original packaging) can be returned or replaced. Items that are not intact, or that have suffered damage attributable to the customer, are generally not accepted.

The legal conditions apply in accordance with the art. 201 CO. Returns are possible within 7 days of receiving the shipment or picking it up in stores. If the customer cannot present the confirmation of receipt, the 7-day period starts from the date of sending the order.

In the case of returning the goods, the shipping costs as well as the shipping risk are borne by the customer. The goods can be returned by post or delivered to the authorized Dr. Vranjes point of sale in Lugano, Quartiere Maghetti 20. The package, containing the goods to be returned, must be sent to the following address:

In the case of free returns to the authorized Dr. Vranjes point of sale, the goods must be presented to the respective customer service, accompanied by a delivery note or order confirmation. It should be noted that the refund takes place only in the same way as the payment at the time of purchase and therefore cannot take place in the form of cash on the spot.

Once the goods have been received, Super Dinamica Sagl checks the returned items and decides, based on their condition, whether to make a total, partial or non-refundable refund. The refund will be made within 10 days of receipt.
The refund concerns exclusively the value of the goods in question. Any shipping costs incurred will not be refunded.

  1. REPLACEMENT
    The ordered goods can only be exchanged in the authorized Dr. Vranjes sales point after receipt of the shipment or by post, in this case the shipping costs will be borne by the customer. Replacements are possible within 7 days of receiving the shipment or picking it up in stores. If the customer cannot present the confirmation of receipt, the 7-day period starts from the sending of the order.

If the goods supplied reach the customer damaged, activate the procedure as for returns.

  1. WARRANTY
    Warranty services must be processed in the authorized Dr. Vranjes point of sale, or a case must be opened by sending an email to info@floressence.ch
  2. DATA PROTECTION
    The collection and processing of customers' personal data by Super Dinamica Sagl are indicated in the specific information on data protection, which is an integral part of these GCS.
    To order in the online shop, the exact name, address and payment details of the customer are required, as well as the e-mail address to send the order and shipping confirmation.
    The customer also expressly accepts the use of their data for direct marketing purposes by Super Dinamica Sagl.
  3. TERMINATION CLAUSE
    The total or partial non-execution by the customer of one of his obligations and the non-compliance with a payment deadline will put Super Dinamica Sagl in the position of: being able to demand payment of the sum due, suspend all deliveries, withdraw from the current contract .
  4. APPLICABLE LAW / DISPUTES
    This contract is governed by Swiss law, excluding the rules of private international law. Exclusive legal forum is Lugano.
  5. AMENDMENTS TO THE GENERAL CONDITIONS OF SALE and SEVERAGE CLAUSE
    Super Dinamica Sagl reserves the right to modify the GCS at any time. The modification can also be made by publication on the Internet. Any changes to the GCS are to be considered accepted as soon as the customer requests further services from Super Dinamica Sagl.
    If one or more provisions contained in this GSC are found to be invalid or illegal, the legality and feasibility of the remaining provisions contained are not affected or prejudiced. In this case the parties undertake to validly regulate the invalid or illegal provision(s).
